Understanding Statutes of Limitations
A statute of limitations sets the maximum time after an event within which legal proceedings may be initiated. These time limits vary by state and type of claim. Missing the deadline means losing the right to sue, regardless of the merits of your case.
Discovery Rule and Tolling
The discovery rule can extend the statute by starting the clock when the injury was discovered (or should have been discovered) rather than when it occurred. Tolling provisions pause the clock for minors, individuals with mental incapacity, or when a defendant is out of state.
